The Happy Cyclist T&Cs
These Terms and Conditions apply to all bookings and participation in guided cycling rides operated by The Happy Cyclist in the New Forest, Hampshire, United Kingdom.
1. Booking and Payment
All ride bookings must be made in advance through our website, email, or an approved booking platform.
Full payment may be required at the time of booking. A booking confirmation will be issued once payment has been received. Bookings are not confirmed until payment has been successfully processed.
2. Cancellation Policy
Cancellations made more than 48 hours before a scheduled ride may receive a full refund.
Cancellations made within 48 hours of the ride may not be refundable.
If The Happy Cyclist cancels a ride due to weather, safety concerns, or operational reasons, participants will be offered either a full refund or an alternative tour date where possible.
3. Participant Responsibilities
Participants must:
- Arrive on time for the scheduled ride
- Follow guide instructions at all times
- Ride responsibly and safely
- Ensure they are physically capable of completing the ride
- Wear appropriate clothing and safety equipment
The Happy Cyclist reserves the right to refuse participation if a rider appears unable to safely complete the ride.
4. Safety
Cycling in natural environments carries inherent risks. By participating in a ride with The Happy Cyclist, participants acknowledge these risks and agree to follow all safety instructions provided by guides.
5. Equipment
Participants using their own bicycles are responsible for ensuring that their equipment is safe and in good working condition.
The Happy Cyclist reserves the right to refuse participation if equipment is considered unsafe.
6. Weather and Conditions
Rides generally operate in most weather conditions. However, if weather or trail conditions create safety concerns, The Happy Cyclist reserves the right to modify or cancel the ride.
7. Liability
Participation in cycling activities involves inherent risks including accidents and injury. By booking a ride, participants acknowledge and accept these risks.
The Happy Cyclist accepts no liability for loss, damage, or injury except where required by law.
8. Changes to Tours
Ride routes and schedules may be adjusted due to weather conditions, safety considerations, rider ability, or operational requirements.
9. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Rider Waiver and Risk Acknowledgement
The Happy Cyclist
By participating in a guided cycling ride with The Happy Cyclist, you acknowledge and agree to the following:
1. Acknowledgement of Risk
Cycling on public roads, gravel tracks, and forest trails involves inherent risks. These may include falls, collisions, mechanical failures, changing terrain, weather conditions, and interactions with other trail users.
Participants understand and accept these risks.
2. Physical Fitness
Participants confirm that they are physically capable of undertaking the ride and do not suffer from any condition that would make participation unsafe.
If participants are unsure about their fitness to participate, they should seek advice from a medical professional before joining a tour.
3. Following Ride Instructions
Participants agree to follow all instructions provided by The Happy Cyclist. This includes safety briefings, route guidance, and riding conduct.
Failure to follow guide instructions may result in removal from the ride for safety reasons.
4. Equipment Responsibility
Participants using their own bicycles are responsible for ensuring that their equipment is safe, well maintained, and suitable for the ride.
5. Limitation of Liability
To the fullest extent permitted by law, The Happy Cyclist shall not be liable for injury, loss, or damage arising from participation in a cycling ride except where caused by negligence.
6. Emergency Medical Treatment
Participants consent to receiving emergency medical assistance if required during the ride.
7. Health Declaration
Participants must inform The Happy Cyclist of any relevant medical conditions, injuries, allergies, or medications that may affect their ability to safely participate in a cycling ride.
This information is used only to help ensure participant safety.
If you have any concerns about your health or ability to participate in physical activity, you should consult a medical professional before joining a ride.
